Administrative Function


The existence and operating of Theewaterskloof Municipality complies with the Constitution of the Republic of South Africa (1996), the Local Government: Municipal Structures Act (Act 117 of 1998); and the Local Government: Municipal Systems Act (Act 32 of 2000).

Theewaterskloof Municipality complies with requirements of the Local Government: Municipal Structures Act (Act 117 of 1998) in terms of “Municipality Areas which must have category A municipalities” which states that “an area must have a single category A municipality if that area can reasonably be regarded as:

  • (a) a conurbation featuring (i) areas of high population density; (ii) an intense movement of people, goods, and services; (iii) extensive development; and (iv) multiple business districts and industrial areas;
  • (b) a centre of economic activity with a complex and diverse economy;
  • (c) a single area for which integrated development planning is desirable; and
  • (d) having strong interdependent social and economic linkages between its constituent units.

The administration of the municipality complies with Part 7 of Act 117 of 1998 that requires that the municipal council must appoint a municipal manager who “is the head of administration and also the accounting officer for the municipality…”; as well as Chapter 5: Functions and Powers of Municipalities of the ACT clause 83 (1): “A municipality has the functions and powers assigned to it in terms of sections 156 and 229 of the Constitution.”

To comply with the functions of a municipal administration Theewaterskloof has Directorates for: Corporate Services, Technical Services, Development Services, Financial Services and Operational Services.

Theewaterskloof Municipality complies with the Local Government: Municipal Systems Act (Act 32 of 2000): Duties of Municipal Administration:

  1. A municipality’s administration is governed by the democratic values and 15 principles embodied in section 195(1) of the Constitution.
  2. The administration of a municipality must:
  • (a) be responsive to the needs of the local community;
  • (b) facilitate a culture of public service and accountability amongst stat,
  • (c) take measures to prevent corruption;
  • (d) establish clear relationships, and facilitate co-operation and communication. between it anti the local community;
  • (e) give members of the local community full and accurate information about the level and standard of municipal services they are entitled to receive; and
  • (f) inform the local community how the municipality is managed, of the costs 25 involved and the persons in charge.
